Course Description

This course considers the role of administrative agencies and the legal and public policy impact of agency decisions. In addition to reviewing the purpose and functions of administrative agencies, the student will also consider the role of judicial review in administrative decisions and the constitutional implications. Additional topics studied include investigatory powers, informal and formal adjudications, rulemaking, a delegation of authority, and separation of powers.

Rationale

As the role of government continues to expand, so has the role of the administrative agency. The ever-expanding role of government has led to the development of multiple administrative agencies that regulate all aspects of citizens’ lives. This course is designed to introduce the student to the foundational principles upon which administrative law has developed, grown, and holds the three branches of government accountable.

Measurable Learning Outcomes

Upon successful completion of this course, the student will be able to:

   3. Apply administrative law principles to various factual situations.
   4. Assess the legality of administrative actions.

Discussions (4)

Discussions are collaborative learning experiences. Therefore, the student is required to provide a thread in response to the provided promptly for each Discussion. Each thread must be at least 400 words and demonstrate course-related knowledge. Assertions in the thread must be supported with at least 2 scholarly resources given in the current Bluebook format. In addition to the thread, the student is required to reply to 2 other classmates’ threads. Each reply must be at least 200 words and be supported with at least 1 scholarly resource. (MLO: A, C, E)

Case Brief Assignments (8)

The student will draft a 2–3-page single-spaced synopsis of 8 different cases. The student will briefly explain the facts, issues, holding, and rationale of each assigned case. Each Case Brief must be written in the current Bluebook format. (MLO: B, D)

Quizzes (2)

The student will have a Quiz: Midterm and a Quiz: Final in this course. Each quiz will cover the Learn material for the module in which it is assigned and the preceding modules. Each quiz will be open-book/open-notes and have a 1-hour and 15-minute time limit. Both quizzes contain 50 multiple-choice and true/false questions. (MLO: A, C)
